Terms of Use and Privacy Policy TOS for the Platform (Participants/Alumni)

The purpose of these general conditions of use is to govern access to and use of the Platform. We invite you to read them carefully.
Access and terms of use of the Platform are defined in the charter of our Augmented Community® ReThink & LEAD below:
All the members connected to this platform shared a strong common experience, at the center of which were a few golden rules:

> Each member of the community is a resource for the others and shares in awareness of the impact that his or her comments may have on others and on his or her company (Please be aware that ReThink & Lead team may moderate, if necessary, to maintain the ethics and spirit of this Augmented Community®)
By activating your account, by requesting an account giving you access to the services of the Platform (hereinafter referred to as "the Account"), by making a reservation for an event or by making a purchase on the Platform, you acknowledge that you have read and accept all these general terms of use.
Scope of the General Terms of Use
The present general terms of use ("hereinafter referred to as the GTC") are applicable to all use and access to the Platform's services. The GCU are accessible at any time on the Platform. Access to the Professional Sharing Platform is not freely available. Access is reserved for Members of the network who have accepted the GTUs and have an Account with a login and password.
Members acknowledge having read and understood the TOS and agree to be bound by them.
ReThink & Lead reserves the right to modify the TOS at any time by notifying by e-mail any new version to the Members, who undertake to take cognizance of these modifications.
Description of the services provided by ReThink & Lead
ReThink & Lead offers to its Members a set of services defined in the Platform such as individual coaching, team coaching, organizational and transformational coaching, change management as well as premium inter-company courses to accelerate internal Transformation.
ReThink & Lead also offers also to connect to a private space to exchange and participate in collective inter or intra-company sessions (hereafter referred to as "the Services").
Conditions of access and use of the Services
The Member of the Platform acknowledges that he/she has the necessary skills and means to access this Platform and that he/she has checked that the computer configuration used does not contain any virus and that it is in perfect working order.
The Member acknowledges and accepts the conditions of access and use of the Services as described below:
- Experience sharing and community work on defined topics between Members
- Sharing and uploading of articles, videos, or experiences between Members
- Exchanges to deepen reflections with your group of Members
To benefit an access to the network, the Member must have an active e-mail address to activate his account and participate in the network. His account must have been created beforehand by an Administrator.
Anonymous visitors can access the Platform, view public articles and events, but cannot visit profiles, post comments, or participate in discussions. They may have access to register for events open to the public. In this case they will have to accept the TOS to reserve their participation in this type of event and provide at least their first name, last name, and an active e-mail.
The Member undertakes not to use a pseudonym or e-mail address that could infringe the rights of third parties (patronymic name, brand name, etc.), nor to usurp a name, a company name or a registered trademark.
At his first connection, the Member will have to accept and validate the TOS, specify his password and update the preferences of his Account with regard to notifications and the level of confidentiality of his profile information. The Member's Account may be deactivated and deleted by an Administrator if it remains inactive for more than two years from the date of the Member's first connection.
Administrators
Administrators represent that they are authorized to use the Services and have accepted the TOS on behalf of ReThink & Lead. The Administrator sets up the configuration of Member Accounts via individual imports or additions. He sets up and validates access requests from Members such as representatives of partner companies. The Administrator can send the accesses to each Member. The Administrator is able to block access to a member if necessary.
Member Accounts
The Member will be able to access the Services once the T&Cs have been validated and only if the Member's Account has been previously created by an Administrator with at least a First Name, a Last Name and an active E-mail. The Member will need to provide at least one active e-mail and will have to specify the password to identify himself at the first connection. The Member can change and update his e-mail and password at any time from the management of his Account. The Member will then access the Member menu to access the different Modules of the platform in accordance with the accesses authorized according to the type of Member.
Password
The password associated with each Account is strictly personal and confidential and must not be shared with third parties. Members are responsible for the loss or theft of their password. We recommend that Members regularly change their passwords and choose complex passwords of at least 8 characters including letters, numbers and specific characters. Each Member is free to change his password at any time from the management of his Account.
Uses of the Services
The texts, software, images, videos, data and any other work present on this Platform are protected by the intellectual property code. The Member of the Platform agrees not to reproduce them without the express consent of ReThink & Lead. The Member agrees not to copy or sell all or part of the Modules and the Platform.
The Member warrants to ReThink & Lead that it has the necessary rights, including all intellectual property rights to the articles, testimonials, comments, images, and data of any kind that it discloses on this Platform, to grant the rights granted herein.
The Member expressly consents, free of charge, to the reproduction and/or representation of his testimonials and comments in the communication media intended for the promotion of ReThink & Lead for the entire legal period of protection of these comments and testimonials.
The messages and images posted are under the responsibility of their author who agrees to assume all responsibilities and consequences related to them. In particular, the author of the message guarantees ReThink & Lead against all actions initiated by third parties and having as cause, basis, or origin the content of his message. He therefore agrees to pay the amount of the related condemnations and defense costs, or any transactional indemnity that would be due in the event of a dispute. The representatives of the Platform decline all responsibility for the content of the messages posted by the Members.
The Member is responsible for the Account assigned to him/her from the date of activation of the latter. It is his duty to keep his Account secret and not to disclose it to any other person. The Member is solely responsible for the use that is made of his Account, as well as the Content published via his Account.
For the respect and good of all, the following are prohibited: messages of an abusive, offensive, obscene or defamatory nature, content that contravenes the rights of others, violent statements or statements that incite racism, pornography, paedophilia or crimes and offences, the misuse of the Platform for propaganda, commercial or political purposes.
Members may report any disturbing messages to the Administrator. The Administrator may delete without notice any message that does not comply with the above conditions.
ReThink & Lead reserves the right, without justification, to deny access to the Platform to any Visitor or Member who has not complied with these terms of use or the applicable law. In the event that, according to the Visitor or Member concerned, this is an error, the latter may contact ReThink & Lead.
Personal data protection and privacy policies
The person responsible for processing the personal data referred to herein is ReThink & Lead. Personal data (hereinafter referred to as "Data"), means any information relating to a natural person who can be identified, directly or indirectly.
The Data, initially integrated, concerning the Members in the Platform comes from ReThink & Lead. This Data is necessary to obtain an Account and access to the services. It includes at least the First Name, Last Name, E-mail.
The other Data are updated optionally by the Members themselves from their profile in order to present their expertise and projects to other Members with the aim of interacting and creating opportunities for exchanges, networking, collaboration and mutual aid.

- Presentation
Personal details (telephone, mobile, personal e-mail(s), main and secondary addresses), date of birth, married name, family status
- Activities in associations, in a board and interests
- Curriculum vitae (via uploaded file or generated using the above information)
The identity of Members is only publicly visible if the Member has activated their public profile or Public CV. Each Member is free to activate or deactivate their public profile at any time.
The identity of Members (First Name, Last Name, Photo, City, Country, Position, Company) is visible to other Members from the Directory (list and map view) and from any interaction on the professional social network through an activity or participation by the Member in an article, event, comment, group or discussion.
Information collected from Network Members via their profile and form can only be viewed by other ReThink & Lead Network Members. Members can limit access to their profile information by managing their privacy level.
External visitors to the network who register for an event must provide at least the following Data:
- First name, Last name, E-mail
Depending on certain events, the following additional data may be required:
- Address, Telephone, Mobile, Date of birth, Current position, Company, Business address, Business e-mail
When paying for a service on the Platform (such as an event ticket, membership, or subscription), we will ask you to provide shipping and billing address information to create an order and associated receipt. We do not store any credit card or bank account information; this information is processed by our online payment processing provider.
When you use the Platform, we automatically collect information, including personal information, about the services you use and how you use them. This information is necessary for the proper performance of the agreement between you and us, for us to comply with legal obligations and in view of our legitimate interest in being able to provide and improve the functionality of the Platform:
- Geolocation Information: When you use certain features of the Platform, we may collect information about your location, either through your IP address or through the GPS of your mobile device, to provide you with a better Member experience. Most mobile devices allow you to control or disable the use of location-based services in applications from the device settings menu.
- Usage Information: We collect information about your interactions on the Platform, such as page views, content views, searches, purchases, and other actions on the Platform to improve the Platform Services.
- Login and Device Data: We automatically collect login and device data when you access the Platform. This information includes but is not limited to information about how you used the Platform, IP address, access dates and times, computer hardware and software data, device data, device usage data, unique identifiers, crash data, cookies. This information allows us to improve the performance of the Platform and the quality of the Services and to detect and prevent fraud, spam, abuse, security incidents and other harmful activities.
Members agree to always provide Personal Information that reflects their actual situation and to update it as necessary to keep it complete and accurate. We will regularly ask you to do so.
The information of a member contained in the database of the professional network remains the property of this Member. In accordance with current European regulations (EU Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016, General Data Protection Regulation hereinafter referred to as "GDPR"), Members of the Platform have the following rights:
- right of access (article 15 RGPD) and rectification (article 16 RGPD), update, completeness of the Members' data
- the right to erase personal data of Members (article 17 of the RGPD),
- right to withdraw consent at any time (Article 13-2c GDPR)
- right to limit the processing of Members' data (Article 18 GDPR)
- right to object to the processing of Members' data (Article 21 RGPD)
- the right to portability of data provided by Members (Article 20 RGPD)
Any Member of the network can freely modify or delete the information he has entered on the network. They can also demand that information about them provided by ReThink & Lead be corrected, completed, clarified, updated, or deleted. No personal information is collected without the knowledge of the network members.
You can exercise this right:
- by modifying your information from the management of your Account, in the "My Profile" section.
- by sending us an email to the following address: contact@rethinkandlead.fr or
- by sending us a letter to the following postal address ReThink & Lead, 14 rue de Marignan, 75008 Paris.
ReThink & Lead is the only one authorized to hold the Data and undertakes not to resell or transmit them to third parties, and that this information will not be processed for any other purpose than its posting on the Platform. ReThink & Lead may process your Data in the context of your access and/or use of the Platform. This includes, in particular, the Data collected by ReThink & Lead when a Member activates his Account or updates information on the Member's profile.
The ReThink & Lead web Platform is protected by the provisions of the Intellectual Property Code, particularly on the protection of databases. Any person who would create a file or a database with the information present on the ReThink & Lead Platform and who would make it available to a third party, for a fee or free of charge, without the agreement of ReThink & Lead and in violation of the GTC, would be exposed to the civil and/or penal sanctions provided for by the Intellectual Property Code.
ReThink & Lead reserves the right to change this Privacy Policy to conform to changes in applicable laws and regulations. Notice of any such changes will be provided via our Platform or by email, where possible, at least thirty days prior to the change taking effect.
Duration of data retention
We will only store your data for as long as is necessary for the purposes for which it is to be used, in accordance with legal requirements.
Security
The Member of the Platform acknowledges that he/she is aware of the risks related to the use of the Internet and networks, and in particular the fact that information relating to Data concerning him/her can be copied or intercepted. The Member of the Platform acknowledges accepting these risks, for which ReThink & Lead cannot be held responsible. On its part, ReThink & Lead implements all the technical and human resources to ensure a permanent level of security in accordance with the rules of the art in force in this field and to prevent attacks from malicious persons. Some of the safeguards we use to protect your information are firewalls and encrypted data transmission using SSL/HTTPS technology.
Warranty
ReThink & Lead undertakes to take particular care regarding the veracity of the information exchanged on the Platform and to keep it regularly updated. However, errors or omissions may be found. In this case, we thank you for informing us so that we can make the necessary corrections. During these verifications and occasional interventions, the Platform Administrator undertakes not to modify the Contents in a way that could change their meaning. However, he reserves the right to move Content if he notices a flagrant error of thematic classification.
ReThink & Lead does not guarantee uninterrupted access to the Platform, particularly in the event of maintenance, repairs, or disruptions of Internet connections. ReThink & Lead is not responsible for technical failures and related data loss, nor for any other indirect damage occurring during or related to the use of the Platform.
Applicable law
The GTU are governed solely by French law. Any dispute arising from the validity, interpretation and/or execution, termination, breach, of these GTUs and after failure of any conciliation, will be submitted to the Commercial Court of Paris.
